29 CFR 1903.19(d)(1): The employer did not submit to the Agency documents demonstrating that abatement is complete for each willful or repeat violation and for any serious violation for which the Agency indicates in the citation that such abatement documentation is required.  a) The employer failed to provide documentation and certification for abatement of citation 1 item 1 in which employees were not provided with fall protection while working on aerial lifts. Condition observed on or about 9/27/14.  b) The employer failed to provide documentation and certification for abatement of citation 1 item 2 in which employees were not protected by guardrail systems, safety net system, or personal fall protection, nor was an alternative fall protection measure provided.  c) The employer failed to provide documentation and certification for abatement of citation1 item 3 in which the employer did not provide a training program on fall hazards.

29 CFR 1926.453(b)(2)(v): A body belt with lanyard attached to the boom or basket was not worn by employee(s) working from an aerial lift:    a- 117 East Maryland Avenue, Beach Haven NJ: An employee, not wearing a body belt with lanyard attached, was exposed to fall hazards in excess of 16 feet to the ground surface below when working from the elevated man lift basket of a Genie Model S-65 articulated boom lift.  Condition observed on or about 09/27/14.    NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM.  FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.

Condition observed on or about 09/27/14.    NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM. 29 CFR 1926.503(a)(1): The employer did not provide a training program for each employee potentially exposed to fall hazards to enable each employee to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards:    a- 117 East Maryland Avenue, Beach Haven NJ: Employees, not wearing any fall protection nor supplied with safety nets, guardrails, etc., were exposed to fall hazards in excess of 16 feet to the ground surface below when performing roof shingle rip, tear, replace, and other related activities from a residential roof with a pitch of approximately 3 on 12.  Another company employee was exposed to fall hazards when operating an articulating boom lift from the man lift basket without the use of a full body harness or body belt.  These employees did not receive any fall protection from the company.  Conditions observed on or about 09/27/14.    NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM.  FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.
