29 CFR 1910.178(l)(4)(iii): Refresher training, including an evaluation of the effectiveness of that training, shall be conducted as required by paragraph (l)(4)(ii) to ensure that the operator has the knowledge and skills needed to operate the powered industrial truck safely. On or about October 1, 2014 employees operating powered industrial trucks were not evaluated at least once within a three year period, exposing employees to the hazards associated with operating a powered industrial truck. Abatement certification is required of this item in accordance with the requirements of 29 CFR 1903.19(c).

29 CFR 1926.95(d)(1): Except as provided by paragraphs (d)(2) through (d)(6) of this section, the protective equipment, including personal protective equipment (PPE), used to comply with this part, was not provided by the employer at no cost to employee(s). On or about October 1, 2014 the employer did not provide at no cost to employees personal protective equipment (fall protection harness) required to safely perform daily work duties.
