29 CFR 1926.503(a)(1): The employer did not provide a training program for each employee potentially exposed to fall hazards to enable each employee to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards:    a) Deaven Steel/Newark Shopping Plaza - Employees walking along the roof's edge of the former goodwill department store, are exposed to a fall hazard of approximately fifteen feet. These employees were not provided any formal training in the recognition of falls and how they are to be prevented. This was observed on October 1, 2014.    b) Deaven Steel/Newark Shopping Plaza - An employee painting a newly installed structural steel frame less than twelve [12] inches from the edge of the future site of the Newark Natural Foods Store was exposed to a fall hazard of approximately fifteen feet while working on the roof's edge. This employee was not provided any formal training in the recognition of falls and how they are to be prevented. This was observed on October 1, 2014.

29 CFR 1926.501(b)(10): Each employee engaged in roofing activities on low-slope roofs, with unprotected sides and edges 6 feet or more above lower levels was not protected from falling by the use of a guardrail system, safety net system, personal fall arrest system, warning line system, or a safety monitoring system.     a) Deaven Steel/Newark Shopping Plaza - Employees walking along the roof's edge of the former goodwill department store without a personal fall arrest system, are exposed to a fall hazard of approximately fifteen feet. These employees working along this unprotected side, were not provided any formal training in the recognition of falls and how they are to be prevented. This was observed on October 1, 2014.    b) Deaven Steel/Newark Shopping Plaza - An employee painting a newly installed structural steel frame, less than twelve [12] inches from the roof's edge of the future site of the Newark Natural Foods Store, without a personal fall arrest system, was exposed to a fall hazard of approximately fifteen feet while working on the roof's edge. This employee working along this unprotected side, was not provided any formal training in the recognition of falls and how they are to be prevented. This was observed on October 1, 2014.

29 CFR 1910.1200(e)(1): The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met:    a) Deaven Steel/Newark Shopping Plaza - The employer did not maintain at the worksite, a site specific hazard communication program for his employees who were exposed to  hazardous chemicals such as, but not limited to xylene and toluene which is a commercial product of Sherwin-Williams, which is identified as a Gray Shop coat primer when painting above the future Newark Natural Foods store. This was observed on October 1, 2014.      b)Deaven Steel/Newark Shopping Plaza - The employer did not maintain at the worksite, a site specific hazard communication program for his employees who were exposed to the hazardous chemical acetylene when performing welding  and cutting activities on the fabricated structural steel located above the former Goodwill department store. This was observed on October 1, 2014.
