29 CFR 1910.176(b): Storage of material created a hazard:    A)    United Lily Ann Cabinets, LLC, located at 1630 Coining Drive, Toledo, OH 43612: On or about October 1, 2014, the employer did not ensure that the shelving units, exposed to powered industrial vehicle's traffic in the warehouse area, were secured to the floor/wall from being tipped over if struck by a powered industrial vehicle. Employees, working in the area, were exposed to struck-by hazards from parts on the shelves and the shelving itself.    In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification.  This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence, or written records.

29 CFR 1910.178(l)(1)(i): The employer did not ensure that each powered industrial truck operator is competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l):    A)    United Lily Ann Cabinets, LLC, located at 1630 Coining Drive, Toledo, OH 43612: On or about October 1, 2014, the employer failed to provide training and evaluation to ensure that employees, operating powered industrial vehicles, such as the Nissan forklift and three Raymond order pickers, were competent to safely complete the task. Employees were exposed to struck-by, caught-in-between, and tip-over hazards.    In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification.  This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence, or written records.

29 CFR 1910.178(q)(7): Industrial trucks were not examined before being placed in service:   A)    United Lily Ann Cabinets, LLC, located at 1630 Coining Drive, Toledo, OH 43612: On or about October 1, 2014, the employer did not ensure that daily examinations of the powered industrial vehicles such as, but not limited to, the Nissan forklift (Model MCPL02A25LV, Chassis # CPL02-9P4379), the Raymond order picker (Model 261-OPC30TT, Serial # 261-02-01943), and the Raymond order picker (Model EASi-OPC30TT, Serial # EASi-97-AB17315) were conducted before being put into service.  In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET).
