OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees:    A.) R.M. Construction, LLC, 2020 Edinboro Road, Erie, PA  16509, first floor, on or about October 2, 2014 and times prior thereto, employees were exposed to impalement hazards from bolts that protrude from the concrete floor.  Employees on-site were performing work duties including, but not limited to, cutting wood lumber with a DeWalt miter saw on the first floor of the structure.  Employees were also accessing a ladder located on the first floor of the structure to access the second floor, and taking lunch breaks on the first floor of the structure.  One-half inch bolts were cemented into the concrete floor, and protruded 2-3 inches out of the concrete floor to secure wood stud wall structures to the first floor.  The protruding bolts were not protected by impalement protection, including, but limited to, caps, cover and troughs.

Construction, LLC, 2020 Edinboro Road, Erie, PA  16509, on or about October 2, 2014 and times prior thereto:  Employees on-site were performing various tasks with equipment / supplies including, but not limited to, fueling a gasoline powered air compressor, operating a SkyTrak rough terrain forklift truck, utilizing electrical power tools to cut wood lumber and utilizing Titebond All Weather Subfloor Adhesive, in and around a wood frame structure.  Portable fire extinguishers were not deployed on the job site when employees were exposed to Class A, B and C fire hazards.

Construction, LLC, 2020 Edinboro Road, Erie, PA  16509, first floor break area, on or about October 2, 2014 and times prior thereto:  A three way splitter was powering equipment, including, but not limited to, a Magic Chef refrigerator and a flexible cord powering a DeWalt 12-inch compound miter saw (M/N:  DW705, S/N:  51698).  The flexible cord for the three way splitter was frayed at the splitter cord cap.      B.)  R.M. Construction, LLC, 2020 Edinboro Road, Erie, PA  16509, second floor, on or about October 2, 2014 and times prior thereto:  Employees were utilizing a Milwaukee circular saw (S/N:  983ED13232235) to perform work tasks including, but not limited to, cutting lumber.  The flexible cord for the Milwaukee circular saw was frayed.      C.)  R.M. Construction, LLC, 2020 Edinboro Road, Erie, PA  16509, second floor, on or about October 2, 2014 and times prior thereto:  Employees were utilizing a flexible extension cord and a Milwaukee SawZall / reciprocating saw (Cat. # 6519-30 / S/N:  C25C313374919) to perform work tasks including, but not limited to, cutting lumber.  The flexible extension cord was frayed.

29 CFR 1926.501(b)(1): Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems:    A.)  R.M. Construction, LLC, 2020 Edinboro Road, Erie, PA  16509, north side of second floor, on or about October 2, 2014 and times prior thereto:  Employees were performing construction tasks on the second floor of the building including, but not limited to, setting exterior walls and performing carpentry tasks.  A guardrail system was installed on the south side of the second floor, but did not continue around to the north side of the second floor exposing employees to a 10.25-feet fall hazard.  Employees were not otherwise protected by a means or method of fall protection including, but not limited to, a completed guardrail system, a safety net system, or personal fall arrest systems.      B.)  R.M. Construction, LLC, 2020 Edinboro Road, Erie, PA  16509, east side of second floor, on or about October 2, 2014 and times prior thereto:  Employees were performing construction tasks on the second floor of the building including, but not limited to, setting exterior walls and performing carpentry tasks.  A complete guardrail system was not constructed on the east side of the building.  The guardrail system contained gaps including, but were not limited to, an 11-inch gap, 18-inch gap and 23-inch gap, in which employees could pass through.  These gaps exposed employees to a 10.25-feet fall hazard.    Employees were not otherwise protected by a means or method of fall protection including, but not limited to, a completed guardrail system, a safety net system, or personal fall arrest systems.    C.)  R.M. Construction, LLC, 2020 Edinboro Road, Erie, PA  16509, south side of second floor, on or about October 2, 2014 and times prior thereto:  Employees were performing construction tasks on the second floor of the building including, but not limited to, setting exterior walls and performing carpentry tasks.  A guardrail system was installed on the south side of the second floor, but was constructed one-foot from the floor edge.   As a result, a one-foot gap existed between the floor edge and guardrail system through which employees could fall.  The condition exposed personnel to a fall hazard of 10.25-feet.  Employees were not otherwise protected by a means or method of fall protection including, but not limited to, a safety net system, or  personal fall arrest systems.

The exterior wall was equipped with a 48-inch by 60-inch wall opening for a window.  Employees setting the wall where the wall opening existed were not utilizing a means or method of fall protection including, but not limited to, personal fall arrest systems (PFAS), guardrail systems, or safety net systems when exposed to a 10.25-feet fall hazard.
