LOCATION: 147 41st street, Industry City Project, Brooklyn, NY On or About October 3, 2014 Employees were connecting/assembling steam pipes on the roof of a two story structure in the center courtyard of the property and were not protected from falling off the roof to the street below by any means of guardrails, safety nets or personal fall arrest systems.

29 CFR 1926.1053(b)(1): Portable ladders were used for access to an upper landing surface and the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface to which the ladder was used to gain access: (a) 147 41st Street, Industry City Project, Brooklyn, NY Utility building in courtyard. On or About October 3, 2014 1). Employees were using an aluminum, single section portable ladder, on the first story roof top, to gain access to the second story roof top. The portable ladder was approximately 18 inches below the upper roof line. 2). Employees were using an 8 foot A frame type ladder at the ground surface to access the roof. This ladder was approximately 2 to 3 feet below the roof line, leaning against the wall.

Employees were standing on the top step to access the roof. NOTE: THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT CERTIFICATION FOR THIS ITEM, FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1,000.00 IN ACCORDANCE WITH 29 CFR 1903.19.
