29 CFR 1926.100(a): Employees working in areas where there was a possible danger of head injury from impact, or falling or flying objects, or from electrical shock and burns, were not protected by protective helmets: (a) Trench located on back side, new residential construction located at 5339 Linholli Circle, Powder Springs, GA 30127: Employee engaged in plumbing activities located in a unprotected 6 ft. deep trench with the spoils pile near the excavated walls and an excavator bucket working in close proximity was not protected from head injuries as a hard hat was not worn while inside the trench.

29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652(c). The employer had not complied with the provisions of 29 CFR 1926.652(b)(1)(i) in that the excavation was sloped at an angle steeper than one-half horizontal to one vertical. (a) Trench located on back side, new residential construction located at 5339 Linholli Circle, Powder Springs, GA 30127: Employee was exposed to soil cave-ins while working in a 3-feet wide x 22-feet long x 6-feet deep excavation while installing a 6-inch PVC sewer line without a cave-in protection system in place. Employer failed to provide a trench shield, soil benching or sloping.
