OSH ACT of 1970 Section (5)(a)(1): Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing for likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of falling from an elevated platform: (a) On or about October 2, 2014, at the Sears Store #2331 in Jefferson City, MO., employees were exposed to serious fall injuries, in that they were not provided with any fall protection equipment when using the Big Joe High Lift Truck (Order Picker) while storing or retrieving merchandise from elevated storage racks in the warehouse areas. As a result, employees were exposed to falls up to approx. 11 feet to the concrete surface below. FEASIBLE METHODS OF ABATEMENT INCLUDE: (1) Utilize only platforms designed for elevating personnel with forklifts, as set forth in ANSI/ASME B56.1-1993, Safety Standard for Low Lift and High Lift Trucks. (2) Ensure employees that operate high-lift trucks (i.e. Order Pickers) use a Full Body Harness and Lanyard as part of a Fall Restraint/Arrest System. (3) Ensure that all trained and certified operators are also trained and certified to recognize and use Fall Protection Equipment when elevated forklift operations and tasks are involved.

29 CFR 1910.178(l)(3)(i)(A): Powered industrial truck operators did not receive training on operating instructions, warnings, and precautions for the types of truck the operator was authorized to operate: (a) On or about October 2, 2014, at the Sears Store #2331 in Jefferson City, MO., The employer did not ensure that all High Lift Truck Operators had been trained to follow the operating instructions, warnings and precautions when they engaged in elevated platform operation activities that required to the use of Fall Protection Equipment while operating the High Lift Truck. As a result, employees were exposed to falls up to approx. 11 feet to the concrete surface below. Abatement certification is required for this item; use the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET for this purpose.
