OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees:    a)  On or about October 2, 2014, an employee was in a fully extended bucket of a Saturn aerial lift, trimming dead limbs off a tree, when the boom failed, dropping the employee approximately 40 feet to the ground.  The employee was tied off inside the bucket and rode the broken aerial lift boom arm to the ground, resulting in serious injuries.  Subsequent inspection revealed that the upper portion of the fiberglass in construction lift arm was previously damaged, compromising it's structural integrity.    Abatement note: Among other methods, the following are feasible and acceptable abatement methods to correct the hazards: 1) Institute a preventative maintenance program according to ANSI/SIA A92.2-2009 2) Conduct daily, monthly and annual inspections as required by ANSI/SAI A92.2-2009  3) Provide training to employees on the proper use of the vehicle mounted elevating and rotating aerial device  4) Ensure the device is marked with its rated load capacity. 5) Display the device operator instructions in a conspicuous location.
