29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b).   The employer does not ensure that employees engaged in residential construction activities 6 feet or more above lower levels were protected by a fall protection system.  This violation occurred on or about October 03, 2014 when an employee was exposed to a fall hazard of more than 6 feet while doing roofing work on a one story residential building being constructed without a fall protection system.   RUBEN MANDEZ WAS PREVIOUSLY CITED FOR A VIOLATION OF THIS OCCUPATIONAL SAFETY AND HEALTH STANDARD OR ITS EQUIVALENT STANDARD 29 CFR 1926.501(b)(13) WHICH WAS CONTAINED IN OSHA INSPECTION NUMBER 466138, CITATION NUMBER 1, ITEM 1 AND WAS AFFIRMED AS A FINAL ORDER ON JULY 16, 2012, WITH RESPECT TO A WORKPLACE LOCATED AT 4802 IBIS LAKE CT., KATY, TX 77449.      RUBEN MANDEZ WAS PREVIOUSLY CITED FOR A VIOLATION OF THIS OCCUPATIONAL SAFETY AND HEALTH STANDARD OR ITS EQUIVALENT STANDARD 29 CFR 1926.501(b)(13) WHICH WAS CONTAINED IN OSHA INSPECTION NUMBER 896645, CITATION NUMBER 1, ITEM 1 AND WAS AFFIRMED AS A FINAL ORDER ON AUGUST 02, 2013, WITH RESPECT TO A WORKPLACE LOCATED AT 5107 LAMPOST HILL CT., KATY, TX 77449.   Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that employees engaged in residential construction activities 6 feet or more above lower levels are protected from falling.

29 CFR 1926.1053(b)(1): Portable ladders were used for access to an upper landing surface and the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface to which the ladder was used to gain access.   The employer does not ensure that ladder used by employee is extended 3 feet above the upper landing surface. This violation was observed at the construction site on October 03, 2014 where an employee was exposed to fall of 8 ft. when using a ladder that was not extended 3 feet above the upper landing.
