Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish to each of his employees employment and a place of employment which were free from recognized struck-by and/or crushed-by hazards that were causing or likely to cause death or serious physical harm to his employees: This violation was observed on or about October 3, 2014, in the warehouse; where employees were exposed to being struck-by and/or crushed by falling objects caused by: a) Storage racks not being anchored to the ground. b) The storage rack system did not have plaques containing the maximum permissible unit load and/or maximum uniformly distributed load per level, and/or the racking system did not have the maximum total load per bay.

29 CFR 1926.501(b)(1): Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems: a) The employer does not ensure that each employee on a walking/working surface with an unprotected side or edge which is 6 feet or more above a lower level is protected from falling by a guardrail system, safety net system, or personal fall arrest system. This violation occurred on or about September 12, 2014, and at times prior thereto, in the warehouse; where employees were not protected from falling from approximately 8-feet while constructing industrial shelving systems.
