29 CFR 1926.102(a)(1): Eye and face protective equipment were not used when machines or operations presented potential eye or face injury from physical, chemical, or radiation agents:    (a) Third floor top plate, new residential construction located at 39 Denton Way, Acworth, GA 30101: Employee was not protected from eye injuries while engaged in framing activities using a pneumatic Hitachi (Model NR83A2-S1) Strip Nail Gun firing 3-inch plastic collated nails at 120 PSI with no safety glasses or goggles.

29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m)  or more above lower levels was not protected by guardrail systems, safety net systems, personal fall arrest systems, or an alternative fall protection measure under another provision of paragraph 1926.501 (b), nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502:     (a) Top plate on third floor, new residential construction located at 39 Denton Way, Acworth, GA 30101: Employees installing ceiling joists at heights of approximately 18-feet, 3-inches from the lower level were not protected from falls as a fall protection system was not provided.    (b) Top plate on second floor, new residential construction located at 39 Denton Way, Acworth, GA 30101: Employees installing roof rafters from the second floor top plate were exposed to falls of approximately 19-feet, 9-inches to the lower level as a fall protection system was not provided.

29 CFR 1926.1052(c)(1)(ii): Stairways having four or more risers or rising more than 30 inches (76 cm), whichever is less, were not equipped with a stairrail system along each unprotected side or edge:    (a) Stairway, new residential construction located at 39 Denton Way, Acworth, GA 30101. Employees used a stairway with an unprotected side to access the upper levels which was 6 risers high and 48-inches from the concrete surface below. Employees using this stairway were exposed to fall hazards as a temporary stair rail system was not provided to allow safe access to the upper and lower levels.
