29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system. a) Vaughn Way, Country Woods, Burlington Twsp., NJ: On or about 10/21/2014 two employees of MJ Lyons were observed installing asphalt paper and shingles on the steep sloped roof of a multi-story new construction residence. The workers were wearing fall protection harness but were not attached to safety lines, and were thus exposed to a fall hazard of greater than 21 feet.

29 CFR 1926.503(a)(1): The employer did not provide a training program for each employee who was exposed to fall hazards that enabled each employee to recognize the hazards of falling and train each employee in the procedures to be followed in order to minimize these hazards. a) Vaughn Way, Country Woods, Burlington Twsp., NJ: On or about 10/21/2014 two employees of MJ Lyons were observed installing asphalt paper and shingles on the steep sloped roof of a multi-story new construction residence. The workers were exposed to a fall hazard of greater than 21. The employer had not trained each employee exposed to fall hazards to recognize the hazards and the procedures to minimize these hazards. NOTE: THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT CERTIFICATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.
