29 CFR 1926.20(b)(1): The employer did not initiate and maintain such programs as may be necessary to comply with the standards set forth in 29 CFR 1926 as evidenced by the violation(s) noted during the course of the inspection:  (a)  On or about August 28, 2014, and prior to that the employer did not develop and/or establish specific work rules to identify hazards that focus on the relationship between the worker, the task, the tools, and the work environment.  Employees were exposed to potential struck by hazards when they accessed a make shift walkway to climb on top of a culvert; employees were exposed to slips trips and/or fall hazards when they accessed the top of a culvert to put in the gasket before the next section is placed and/or disconnect the crane.  Employees were exposed to slips, trips and/or falls while they were not provided with proper access/egress into an excavation.   Note: Abatement certification IS required for this item.

29 CFR 1926.501(b)(1): Employees on walking/working surfaces with an unprotected side and/or edge which is 6 feet or more above a lower level were not protected from falling by guardrail systems, safety net systems, or personal fall arrest systems:  a)  On August 28, 2014, and at times prior thereto, after each concrete box culvert section was set an employee was required to access the top of the box culvert to disconnect the crane and exposed to a potential 11 foot 8 inch fall hazard. 29 CFR 1926.502(a)(2): The employer did not provide and/or install all fall protection systems required by this subpart for an employee, and did not comply with all other pertinent requirements of this subpart before that employee begins the work that necessitates the fall protection.  (a)  On or about August 28, 2014, and at time prior thereto, employees utilized an 37 inch wide area located above the excavation as a pathway to access to top of a concrete culvert and exposed to a potential fall hazard. 29 CFR 1926.651(k)(1): Daily inspections of excavations, the adjacent areas, and protective systems were not made by a competent person for evidence of a situation that could result in possible cave-ins, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions.  An inspection was not conducted by the competent person prior to the start of work and as needed throughout the shift.
