OSH ACT of 1970 Section (5)(a)(1): Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm in that employees were exposed to sub-zero temperatures capable of causing hypothermia and/or frostbite. (a)Save-A-Lot @ 4860 Pecos Street, Denver, CO: On and prior to October 1st, 2014, the employer did not ensure that employees working inside a Hussmann brand walk-in freezer were capable of opening the freezer door from the inside due to a broken latch mechanism. The interior mushroom plunger was substantially bent and incapable of opening the door from the inside. The condition exposed employees to sub-zero temperatures capable of causing hypothermia and/or frostbite. Abatement Note: Among other methods, one feasible and acceptable abatement method to correct the hazard is to maintain the equipment in the same condition as which it was built by the manufacturer and to adhere to the National Sanitation Foundation Standard (NSF/ANSI 7-2009). Paragraph 8.1.2.4 states that freezer doors shall be capable of being opened from the inside, even when locked.
