29 CFR 1926.651(j)(2): Protection was not provided by placing and keeping excavated or other materials or equipment at least 2 feet from the edge of excavations, or by the use of retaining devices that were sufficient to prevent materials or equipment from falling or rolling into excavations, or by a combination of both if necessary: a) 156 New Brunswick Avenue, Hopelawn, NJ 08861. The employer allowed his employees to work in an excavation 7 foot deep when the spoil piles were not placed at least 2 foot back from the edge nor was there any retaining device in place to protect them from materials or equipment rolling into the excavation exposing them to crushing and struck by hazards. Condition occurred on or about 10/06/14.

29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with paragraph (b) or (c) of this section. Excavation was not made entirely in stable rock and exceeded 5 foot in depth. a) 156 New Brunswick Avenue, Hopelawn, NJ 08861. The employer allowed his employees to work in an excavation 7 foot deep with no protective system in place that would protect them from cave-in hazards. Condition occurred on or about 10/06/14.
