On or about October 7, 2014, and at times prior thereto, the employer did not ensure two employees who were roofing using a Hitachi Air Nail Gun were provided with eye protection exposing the employees to eye and face injuries.

29 CFR 1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed: On or about October 7, 2014, and times prior thereto, employees performing roofing work were using an extension ladder that did not extend (3) feet above the landing to access and egress the roof. The employees were exposed to a fall hazard of up to (8) feet to the ground below.

29 CFR 1926.501(b)(11): Each employee on a steep roof with unprotected sides and edges 6 feet (1.8 m) or more above lower levels was not protected from falling by guardrail systems with toeboards, safety net systems, or personal fall arrest systems: On or about October 7, 2014, on the north side of the residential construction site, employees who worked without fall protection were exposed to a fall hazard of approximately 8 feet while engaged in roofing activities. Eduardo Diaz Gonzalez was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 918909, citation number 1 , item number 2 and was affirmed as a final order on July 31, 2013 with a final abatement date of August 14, 2013, with respect to a workplace located at 1500 Dale Lane, White Settlement, Texas.
