29 CFR 1926.404(b)(1)(i): Employer did not use either ground fault circuit interrupters as specified in paragraph (b)(1)(ii) of this section, or an assured equipment grounding conductor program as specified in paragraph (b)(1)(iii) of this section to protect employees on construction sites. a) On or about 10/06/14, in the basement, swimming pool area, Tishman Bldg., 447 Main St., Buffalo, NY: A Heavy Duty D Handle Drill with a mixing paddle attachment was used to mix grout. The drill was connected to 120 volt ac power via an extension cord which was plugged into a permanent power receptacle on the wall. No GFCI or assured equipment grounding program was being used. NO ABATEMENT CERTIFICATION REQUIRED
