29 CFR 1910.95(c)(1): The employer did not administer a continuing, effective hearing conservation program as described in 29 CFR 1910.9(c) through (o) whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level of 85 decibels measured on the A scale, or equivalently a dose of fifty percent:     This violation occurred on or about February 28, 2015 when the employer did not administer a hearing conservation program for employees exposed to noise that exceeded an 8-hour time-weighted average (TWA) of 85 dBA.       a.  A blower working on machine 1 was exposed to continuous noise levels at 67.59% of the permissible 8-hour TWA.  The equivalent dBA level of 67.59% is approximately 87.1 dBA.  Sampling was performed for 451 minutes during one shift.  Zero exposure was assumed for the un-sampled period of 29 minutes;     b.  A fiber filler and packer working on machine 17 was exposed to continuous noise levels at 80.20% of the permissible 8-hour TWA.  The equivalent dBA level of 80.20% is approximately 88.4 dBA.  Sampling was performed for 468 minutes during one shift.  Zero exposure was assumed for the un-sampled period of 12 minutes;       c.  A fiber filler and packer working on machine 19 was exposed to continuous noise levels at 89.84% of the permissible 8-hour TWA.  The equivalent dBA level of 89.84% is approximately 89.2 dBA.  Sampling was performed for 467 minutes during one shift.  Zero exposure was assumed for the un-sampled period of 13 minutes;       d.  A fiber filler and packer working on machine 17 was exposed to continuous noise levels at 71.07% of the permissible 8-hour TWA.  The equivalent dBA level of 71.07% is approximately 87.5 dBA.  Sampling was performed for 464 minutes during one shift.  Zero exposure was assumed for the un-sampled period of 16 minutes.
