29 CFR 1910.1200(e)(1): Employer had not developed or implemented a written hazard communication program which at least describes how the criteria specified in paragraphs (f), (g), and (h) of this section for labels and other forms of warning, material safety data sheets, and employee information and training will be met: (Construction Reference: 1926.59)    Jobsite: On or about August 14th, 2014, employees were required to perform hot work operations, such as, but not limited to, torch cutting and welding of stainless steel pipes, and therefore exposing workers to hazardous chemicals, such as, but not limited to, welding gases, welding flux, and welding fumes (possibly containing hexavalent chromium). Yet the employer is failing to establish and implement a hazard communication program that includes, but not limited to, a list of hazardous chemicals and employee training on safety data sheets.    Abatement certification and abatement documentation is required for this violation. The documentation should include written verification of abatement, applicable measurements or monitoring results, and photographs or videos which you believe will be helpful. The abatement certification sheet is enclosed with the citations.

29 CFR 1910.1200(h)(1): Employees were not provided effective information and training on hazardous chemicals in their work area at the time of their initial assignment and whenever a new hazard that the employees had not been previously trained about was introduced into their work area: (Construction Reference: 1926.59)    Jobsite: On or about August 14th, 2014, employees were required to perform hot work operations, such as, but not limited to, torch cutting and welding of stainless steel pipes, and therefore exposing workers to hazardous chemicals, such as, but not limited to, welding gases, welding flux, and welding fumes (possibly containing hexavalent chromium). 29 CFR 1926.50(b): Provisions were not made prior to commencement of the project for prompt medical attention in case of serious injury:    Jobsite: The employer did not take reasonable steps to ensure medical attention was obtained as quickly as possible in the case of serious injury or illness, for employees engaged in the task of installing pneumatic grain bin air systems and transfer augers. On or about August 14th, 2014, as a result of exposure to heat, an employee sustained an acute kidney injury from heat exhaustion. The employee was not taken to the hospital until after the shift ended.    Abatement certification is required for this violation.  The abatement certification sheet is enclosed with the citations.

29 CFR 1904.7(b)(5): The employer did not record on the OSHA 300 Log a work-related injury or illness where the employee received medical treatment beyond first aid;     Scott-Hourigan Co. @ 164 W Nobes Rd, York, NE 68467: The employer is failing to record on the OSHA 300 Log, or its equivalent, a work-related injury or illness where the employee received medical treatment beyond first aid.  On or about August 14th, 2014, while performing the tasks of installing a pneumatic grain bin air system and a transfer auger, an employee sustained an acute kidney injury from heat exhaustion due to dehydration and rhabdomyolysis. The injured employee was hospitalized for two days; received intravenous fluids which were required to treat his dehydration; and was prescribed medication. This clearly demonstrates that the injury resulted in medical treatment beyond first aid, which meets the general recording criteria, and therefore is recordable.    Abatement Certification and Documentation is required. The abatement certification sheet is enclosed with the citations.

29 CFR 1904.29(a): A log of all Work-Related Injuries and Illnesses (OSHA Form 300) and for the Summary of Work-Related Injuries and Illnesses (OSHA Form 300-A), and/or the Injury and Illness Incident Report (OSHA Form 301) or equivalent forms were not kept by the establishment:    Scott-Hourigan Co. @ 164 W Nobes Rd, York, NE 68467: The employer is failing to record workplace injuries or illnesses and thus,  keeps neither a log of all Work-Related Injuries and Illnesses (OSHA Form 300) nor the Summary of Work-Related Injuries and Illnesses (OSHA Form 300-A), nor the Injury and Illness Incident Report (OSHA Form 301) nor equivalent forms.    On or about August 14th, 2014, while performing the tasks of installing a pneumatic grain bin air system and a transfer auger, an employee sustained an acute kidney injury from heat exhaustion due to dehydration and rhabdomyolysis. This injury resulted in medical treatment beyond first aid, which meets the general recording criteria, and therefore is recordable. By failing to record workplace injuries and/or illnesses, the employer is depriving itself of information that raises awareness of the kind of injuries occurring in the workplace. Also, not recording affects the ability of employees to better learn about and understand the hazards of their job.    Abatement Certification and Documentation is required.
