29 CFR 1926.502(b)(1): The top edge height of the top rails, or equivalent guardrail system members, was not 42 inches plus or minus 3 inches above the walking/working level: a. 2nd story decking- On 10/5/2014 employees performing concrete pouring and finishing operations were not protected from falls of 14 feet when wooden guardrail systems used for fall protection were positioned so that the top-rail heights ranged between 33.5 inches and 35.5 inches. b. 2nd story decking loading zone- On 10/5/2014 employees performing concrete pouring and finishing operations were not protected from falls of 14 feet when wire rope guardrail systems used for fall protection were positioned too loosely resulting in the top-rail height sagging to as low as 25.5 inches. c. 2nd story decking- On 10/6/2014 employees unloading Styrofoam insulation panels were not protected from falls of 14 feet when wooden guardrail systems used for fall protection were positioned so that the top-rail heights ranged between 33.5 inches and 35.5 inches. d. 2nd story decking loading zone- On 10/6/2014 employees unloading Styrofoam insulation panels were not protected from falls of 14 feet when wire rope guardrail systems used for fall protection were positioned too loosely resulting in the top-rail height sagging to as low as 25.5 inches.

29 CFR 1926.502(b)(2)(i): Midrails were not installed at a height midway between the top edge of the guardrail system and the walking/working level: a. 2nd story decking- On 10/5/2014 employees performing concrete pouring and finishing operations were not protected from falls of 14 feet when wooden guardrail systems used for fall protection were positioned so that the mid-rail height was only 18 inches off the ground. b. 2nd story decking loading zone- On 10/5/2014 employees performing concrete pouring and finishing operations were not protected from falls of 14 feet when wire rope guardrail systems used for fall protection were positioned too loosely resulting in the mid-rail height sagging to as low as 2 inches. c. 2nd story decking- On 10/6/2014 employees unloading Styrofoam insulation panels were not protected from falls of 14 feet when wooden guardrail systems used for fall protection were positioned so that the mid-rail height was only 18 inches off the ground. d. 2nd story decking loading zone- On 10/6/2014 employees unloading Styrofoam insulation panels were not protected from falls of 14 feet when wire rope guardrail systems used for fall protection were positioned too loosely resulting in the mid-rail height sagging to as low as 2 inches.
