29 CFR 1910.147(c)(6)(i): The employer did not conduct a periodic inspection of the energy control procedure at least annually to ensure that the procedure and the requirement of this standard were being followed:  a) Throughout facility: The employer did not conduct periodic inspections of the energy control procedures at least annually for tasks involving lockout tagout, such as, but not limited to, cleaning the mixer, cleaning the hopper and repair of the conveyor belt system including replacement of rollers and cement screws, on or about 10/9/14.  NOTE: THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT CERTIFICATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.

29 CFR 1910.179(j)(2)(iii): A certification record which includes the date of inspection, the signature of the person who performed the inspection and the serial number, or other identifier, of the hook inspected, was not maintained:  a) Silica fume hood located next to the plant: Certification inspection records including the date of inspection, the signature of the person conducting the inspection and the serial number or identifier of the hook on a CM Lodestar crane used to lift bags of silica and add them to the cement trucks, were not maintained, on or about 10/9/14.   NOTE: THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT CERTIFICATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.
