29 CFR 1926.452(w)(1): Scaffold was not braced by cross, horizontal, or diagonal braces, or combination thereof, to prevent racking or collapse of the scaffold and to secure vertical members together laterally so as to automatically square and align the vertical members. Scaffold was not plumb, level, and squared.    a) J Gill & Co. -  On or about October 9, 2014, the employer did not ensure that the tubular welded scaffold the employee was working from was plumb, level, and squared.     b) J Gill & Co. -  On or about October 30, 2014, the employer did not ensure that the tubular welded scaffold the employee was working from while he was conducting concrete repair operations was plumb, level, and squared.

29 CFR 1926.454(b): The employer did not have each employee involved in erecting, disassembling, moving, operating, repairing, maintaining, or inspecting a scaffold trained by a competent person to recognize any hazards associated with the work in question.    a) J Gill & Co. - The employer did not have a competent person train employees engaged in erecting scaffolding at the Des Plaines Library parking garage in the following: the nature of scaffold hazards; the correct procedures for inspecting and erecting the tubular welding scaffold (including its components); the scaffold's design criteria, maximum intended for load-carrying capacity and intended use of the scaffold.

29 CFR 1926.59 NOTE: The requirements applicable to construction work under this section are identical to those set forth at 29 CFR 1910.1200 of this chapter.     29 CFR 1910.1200(h)(3)(ii): The employee training did not include the physical, health, simple asphyxiation, combustible dust, and pyrophoric gas hazards, as well as hazards not otherwise classified, of the chemicals in the work area;    a), J Gill & Co. - The employer did not train employees on the physical and health hazards of the chemicals in the work area.  The employees who were conducting parking garage repair were exposed to hazardous chemicals, including, but not limited to, crystalline silica dust from grinding and cutting concrete.
