29 CFR 1926.100(a): Employees working in areas where there was a possible danger of head injury from impact, or falling or flying objects, or from electrical shock and burns, were not protected by protective helmets:       (a) Jobsite:  On or about October 9, 2014, an employee was working next to an 11 1/2 foot vertical sidewall to an excavation and he was not wearing a hard hat.

29 CFR 1926.651(k)(2): Where the competent person found evidence of a situation that could result in possible cave-in, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions, exposed employee(s) was/were not removed from the hazardous area until the necessary precautions have been taken to ensure their safety:        (a) Jobsite:  On or about October 9, 2014, the competent person did not remove two employees from an 11 1/2 foot deep excavation that was not shored nor sloped.  In addition, there were no soil tests done to determine the class of soil that the employees were working with.

29 CFR 1926.1053(b)(1): Portable ladders were used for access to an upper landing surface and the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface to which the ladder was used to gain access:      (a)  Jobsite:  On or about October 9, 2014, employees were using a 16 foot extension ladder to exit/enter the 11 1/12 foot deep excavation and the ladder only extended about 6 inches above grade.
