29 CFR 1926.100(a): Employees working in areas where there was a possible danger of head injury from impact, or falling or flying objects, or from electrical shock and burns, were not protected by protective helmets. On or about 4 September 2014, and at times prior thereto, two framers were installing black insulation boards and wrap to the outside walls of a residence under construction without the use of head protection while others were working inside on the second floor, exposing the framers to the hazard of being struck by falling materials, tools, or debris.

29 CFR 1926.451(g)(1)(vii): Each employee on a scaffold, not otherwise specified in paragraphs (g)(1)(i) through (g)(1)(vi) of this section, more than 10 feet (3.1 m) above lower level was not protected from falls by the use of personal fall arrest systems or guardrail systems meeting the requirements of paragraph (g)(4) of this section. On or about 4 September 2014, and at times prior thereto, four framers were installing either black insulation boards or home guard wrap on the outside walls of a residence under construction from two separate pump jack scaffolds while at ten feet or higher. 1) Two framers were on the right side of the residence under construction installing home guard wrap while on the pump jack scaffold without fall protection, exposing the two framers to a fall hazard of approximately 11 feet 8 inches to the ground below. 2) Two framers were on the left side of the residence under construction installing black insulation boards while on the pump jack scaffold without fall protection, exposing the two framers to a fall hazard of approximately 12 feet 9 inches to the ground below.
