29 CFR 1910.134(d)(1)(iii): The employer did not identify and evaluate the respiratory hazard(s) in the workplace; including a reasonable estimate of employee exposures to respiratory hazards and identification of the contaminant's chemical state and physical form. On or about 8 October 2014, and at times prior thereto, an employee was dry cutting bricks with a masonry saw without respiratory protection being provided by the employer, exposing the worker to respiratory hazards from quartz silica, a potential human carcinogen.

29 CFR 1926.102(a)(1): Eye and face protective equipment were not used when machines or operations presented potential eye or face injury from physical, chemical, or radiation agents. On or about 8 October 2014, and at times prior thereto, a mason was utilizing a masonry saw in a dry method without eye or face protection, exposing the worker to the hazard of being struck by flying debris.

29 CFR 1926.451(e)(1): When scaffold platforms were more than 2 feet (0.6 m) above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from other scaffold, sturcure, personnel hoist, or similar surface was not used. Crossbraces were used as a means of access. On or about 8 October 2014, and at times prior thereto, two workers were accessing the tubular welded frame scaffold without the access ladder extending to the full height of the work platform, exposing the workers to a fall hazard up to approximately 12 feet high.
