29 CFR 1926.102(a)(1): Eye and face protective equipment were not used when machines or operations presented potential eye or face injury from physical, chemical, or radiation agents. On or about 9 October 2014, and at times prior thereto, a framing crew installing trusses on apartment units under construction utilized pneumatic nail guns without the use of eye protection, exposing the workers to the hazard of being struck by flying objects. 1) Apartment Building 4 2) Apartment Building 5

29 CFR 1926.501(b)(1): "Unprotected sides and edges." Each employee on a walking/working surface (horizontal and vertical surface) with an unprotected side or edge which is 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems. On 9 October 2014, and at times prior thereto, two framers were installing trusses on the second story top plate of an apartment building under construction near the outer edge without fall protection, exposing the workers to a fall hazard of approximately 23 feet 4 inches to the ground below.
