29 CFR 1926.102(a)(1): Eye and face protective equipment were not used when machines or operations presented potential eye or face injury from physical, chemical, or radiation agents. On or about 9 October 2014, and at times prior thereto, framers were utilizing either a handheld circular saw to cut pieces of floor decking or pneumatic nail guns to install trusses on apartment buildings under construction without the use of eye protection, exposing the workers to the hazard of being struck by flying objects. 1) A framer was utilizing a handheld circular saw to cut pieces of floor decking on Building 5 without the use of eye protection, exposing the worker to the hazard of being struck by flying objects. 2) A framing crew was utilizing pneumatic nail guns to install trusses on Buildings 4 without the use of eye protection, exposing the workers to the hazard of being struck by flying objects. 3) A framing crew was utilizing pneumatic nail guns to install trusses on Buildings 5 without the use of eye protection, exposing the workers to the hazard of being struck by flying objects.

29 CFR 1926.501(b)(1): "Unprotected sides and edges." Each employee on a walking/working surface (horizontal and vertical surface) with an unprotected side or edge which is 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems. On 9 October 2014, and at times prior thereto, three workers were performing various framing activities while on the second story top plate of two separate buildings without fall protection, exposing the framers to a fall hazard of approximately 23 feet. 1) A framer was measuring and cutting floor decking while at the edge of the second story top plate of an apartment building under construction without fall protection and a fall height of approximately 23 feet 4 inches to the concrete below. 2) Two framers were installing trusses on the second story top plate of an apartment building under construction near the outer edge without fall protection and a fall height of approximately 23 feet 4 inches to the ground below.
