OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of being struck-by and caught-in machinery with no emergency stop control: a. On or about August 26, 2014, in the frozen product area, the employer did not ensure the emergency stops of the Dorner transfer conveyors were operating properly, exposing employees to being struck-by and caught-in by the conveyors. Among other methods, a feasible abatement method to correct this hazard was to comply with The American Society of Mechanical Engineers (ASME) B20.1-2009, Safety Standard for Conveyors and Related Equipment, Sections 5.12 (g) and (h), regarding that under no circumstance shall the safety characteristic of the conveyor be altered; and routine inspections and corrective maintenance measures shall be conducted to ensure all guards and safety features and devices are retained and function properly.

29 CFR 1910.147(c)(4)(i): Procedures were not developed, documented and utilized for the control of potentially hazardous energy when employees were engaged in activities covered by this section: a. On or about October 8, 2014, in the frozen production area, the employer did not have written specific energy control procedures that precisely outline the scope, rules and steps for the control of hazardous energy of the Treif Divider 660+ meat slicer, Grote Horizontal Bisector bread slicer, and Fuji Foremost Alpha VII seal wrapper, among other machinery with potential to store energy, exposing employees to caught-in and amputation hazards.
