29 CFR 1910.147(c)(1):  Energy control program. The employer shall establish a program consisting of energy control procedures, employee training and periodic inspections to ensure that before any employee performs any servicing or maintenance on a machine or equipment where the unexpected energizing, startup or release of stored energy could occur and cause injury, the machine or equipment shall be isolated from the energy source and rendered inoperative:       (a)  There was no program on energy control procedures, employee training, and periodic inspections, to include providing locks and training to employees loading wire, replacing cutters, replacing the die and replacing the grippers on the MW Glader Nail Machine and employees replacing dies and punches on the mechanical power presses.

29 CFR 1910.212(a)(1):  Types of guarding. One or more methods of machine guarding shall be provided to protect the operator and other employees in the machine area from hazards such as those created by point of operation, ingoing nip points, rotating parts, flying chips and sparks. Examples of guarding methods are-barrier guards, two-hand tripping devices, electronic safety devices, etc.:     (a)  On or about January 21, 2015, an employee operating the Cuphead Machine #2 was exposed to the inadequately guarded nail punch, in that there was a 2 inch gap between the guard and the table.    (b)  Employees operating the MW Gladder Nail Machine was exposed to an inadequately guarded machine, in that the guards, including the one covering the stop and the feeder, were not interlocked.    (c)  The chuck on the South Bend 400 Machine Lathe was not guarded.

29 CFR 1910.217(e)(1)(i): It shall be the responsibility of the employer to establish and follow a program of periodic and regular inspections of his power presses to ensure that all their parts, auxiliary equipment, and safeguards are in a safe operating condition and adjustment. The employer shall maintain a certification record of inspections which includes the date of inspection, the signature of the person who performed the inspection and the serial number, or other identifier, of the power press that was inspected.    (a)  There was no program of periodic inspections of the mechanical power presses.

29 CFR 1910.219(c)(2): Guarding horizontal shafting:    (a)  There was 15 inches of exposed drive shaft on the Cuphead Machine #2 and 14 inches of exposed drive shaft on the Cuphead machine #5 and they were both less than 7 feet above the floor.
