OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees:     On or about October 9, 2014, at the job site an employee was observed climbing on the guardrails of an aerial lift to access the roof of a building.  This exposed the employee to fall hazards.

29 CFR 1926.451(b)(1): Each platform on all working levels of scaffolds was not fully planked or decked between the front uprights and the guardrail supports as specified in paragraphs 1926.451(b)(1)(i)-(ii):    On or about October 9, 2014, at the jobsite an employee was exposed to a fall of greater than ten feet while working from a mobile scaffold which did not have the working level fully planked between the uprights.  The employee was exposed to fall hazard.

29 CFR 1926.451(g)(1): Each employee on a scaffold more than 10 feet above a lower level were not protected from falling to that lower level:    On or about October 9, 2014, an employee was observed working from a second level of a mobile scaffold approximately ten feet eight inches high which did not have guard rails provided and the employee was not wearing a personal fall arrest harness.  The employee was exposed to fall hazards.

The employee was wearing personal fall arrest system but not tied off.  The employee was exposed to fall hazards.
