29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):     a)  On or about October 14, 2014 at 87 Hunting Road in the Village of Colonie, NY 12205 an employee was exposed to a fall hazard working on gutter installation work of approximately 9 feet 8 inches above the ground at one location and approximately 15 feet at another location without using any means of fall protection.

29 CFR 1926.503(a)(1): The employer did not provide a training program for each employee who might be exposed to fall hazards:  a)  On or about October 14, 2014 at 87 Hunting Road in the Village of Colonie, NY 12205 an employee was exposed to a fall hazard of greater than 6 feet without using any means of fall protection.  He did not receive a training program from his employer concerning fall hazards and the procedures to be followed to minimize these hazards.

29 CFR 1926.95(a): Personal protective equipment, including personal protective equipment for eyes, face, head, and extremities, protective clothing, respiratory devices, and protective shields and barriers, was not provided, used, or maintained in a sanitary and reliable condition it was necessary by reason of hazards of processes or environment, chemical hazards, radiological hazards, or mechanical irritants encountered in a manner capable of causing injury or impairment in the function of any part of the body through absorption, inhalation, or physical contact:    a) On or about October 14, 2014 at 87 Hunting Road in the Village of Colonie, NY 12205 an employee was exposed to a struck by hazard that could cause injuries to the head and eyes because he was not wearing safety glasses or personal protective equipment for the head while working with a power tool and another employee was working on the roof with a hand tool almost directly overhead of the first worker.
