29 CFR 1910.119(e)(3)(i): The process hazard analysis did not address the hazards of the process.    The employer does not address the hazards of loading fresh anhydrous ammonia in the process hazard analysis (PHA).      The violation occurred in the Tom Thumb Distribution Center facility on or about October 8, 2014, and at times prior thereto where employees were exposed to inhalation, fire, and explosion hazards from potential releases of anhydrous ammonia when the employer failed to ensure that the hazards of loading fresh anhydrous ammonia were addressed in the process hazard analysis.       Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that the hazards of loading  fresh anhydrous ammonia are addressed in the process hazard analysis.

29 CFR 1910.119(j)(4)(iii): The frequency of inspections and tests of process equipment was not consistent with applicable manufacturers' recommendations and good engineering practices, and more frequently if determined to be necessary by prior operating experience.    The employer does not ensure that the frequency of inspection and tests of process equipment are consistent with recognized and generally accepted good engineering practices.    The violation occurred on or about October 8, 2014 and at times prior thereto in the ammonia refrigeration system where employees were exposed to inhalation, fire, and explosion hazards from potential releases of anhydrous ammonia when the employer failed to ensure that the full independent inspections on pressure vessels and heat exchangers at a frequency were conducted consistent with International Institute of Ammonia Refrigeration (IIAR) Bulletin 110 such as but not limited to the following vessels and heat exchangers:    1.  High Pressure Liquid Receiver (HPLR-1)   2.  Evaporator, EV-1  3.  Evaporator, EV-3     Pursuant to 29 C.F.R. 1903.19 within ten (10) calendar days of abatement date the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that the frequency of inspection and tests of process equipment are conducted consistent with recognized and generally accepted good engineering practices.

The employer does not ensure that process safety information pertaining to the equipment in the process includes relief system design and design basis.    The violation occurred on or about October 8, 2014 and at times prior thereto in the ammonia refrigeration system where employees were exposed to inhalation, fire and explosion hazards from potential releases of anhydrous ammonia when the employer failed to ensure that the relief system including design and design basis for pressure relief valves (or pressure safety valves) was documented such as but not limited to the following pressure relief valves:      1.      2 PSVs for ER-HPR-1(High Pressure Recirculator)  2.      2 PSVs for ER-LPR-1 (Low Pressure Recirculator)  3.      All PSVs for compressor skid, ER-C-4  4.      2 PSVs for  ER-HPLR-1(High Pressure Liquid Receiver)        Pursuant to 29 C.F.R. 1903.19, within (10) calendar days of the abatement date the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that process safety information pertaining to the equipment in the process includes relief system design and design basis

29 CFR 1910.119(h)(2)(vi): The employer did not maintain a contract employee injury and illness log related to contractor's work in process areas    The employer does not ensure that a contract employee injury and illness log related to work in the process areas is maintained.     The violation occurred in the Tom Thumb Distribution Center facility on or about October 8, 2014 and at times prior thereto where the employer failed to maintain a contract employee injury and illness log related to the contractors work in the ammonia refrigeration area.  This condition exposed employees to inhalation, fire, and explosion hazards from potential releases of anhydrous ammonia.     Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation showing it is in compliance with the standard, including describing the steps it is taking to ensure that contract employee injury and illness log related to work in the process areas is maintained
