29 CFR 1926.651(j)(2): Protection was not provided by placing and keeping excavated or other materials or equipment at least 2 feet (.61m) from the edge of excavations, or by the use of retaining devices that were sufficient to prevent materials or equipment from falling or rolling into excavations, or by a combination of both if necessary.    Location:  100 Wintergreen Avenue, New Haven, CT 06501      The excavated soil spoil piles were placed less than 2 feet from the edge of the trench with no means to prevent the soil from entering back into the trench.

29 CFR 1926.651(k)(1): Daily inspections of excavations, the adjacent areas, and protective systems were not made by a competent person for evidence of a situation that could have resulted in possible cave-ins, indications of failure of protective systems    Location:  100 Wintergreen Avenue, New Haven, CT 06501      A competent person did not make daily inspections of the trench and adjacent areas to identify trenching and excavation hazards and trench and excavation cave-ins hazards.

29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652(c) and a proper sloping design system in accordance with 29 CFR 1926.562(b).    Location:  100 Wintergreen Avenue, New Haven, CT 06501      The employees working in a 6 foot deep portion of a large trench were not protected from cave-ins hazards by an adequate shielding system or proper sloping design.    Consequently, on October 14, 2014, the 6 foot deep trench collapsed trapping worker inside the unprotected trench.
