OSH ACT of 1970 Section (5)(a)(1): OSH ACT of 1970 Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fall from elevation/caught in-between hazards: a) At 605 West 47th Street (County Club Plaza) in Kansas City, MO 64112 - An employee climbed out of a "JLG" 660SJ articulating lift onto a steep-slope clay tile roof, three stories above the lower concrete surface, without having the boom fully lowered, and using the articulating lift as a personal fall arrest anchor point while working from the roof surface, creating fall from elevation/caught in-between hazards. NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19

29 CFR 1910.67(c)(2)(iv): Employees did not always stand firmly on the floor of the basket, and were allowed to sit or climb on the edge of the basket or use planks, ladders, or other devices for a work position: a) At 605 West 47th Street (County Club Plaza) in Kansas City, MO 64112 - An employee climbed over the guardrails of a "JLG" 660SJ articulating lift onto a steep-slope clay tile roof, three stories above the lower concrete surface, creating machine tip-over hazards leading to fall from elevation and/or caught in-between machine and concrete hazards. NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19
