OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish the employees employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees: a) 23 Double Trouble Road, Bayville, NJ 08721: On or about October 9, 2014, the employer failed to ensure each employee was protected from crushing hazards associated with unexpected movement of equipment. Employees stand beneath cars that are supported by concrete forms in order to prepare them for recycling.

29 CFR 1910.178(p)(1): Powered industrial trucks found to be in need of repair, defective, or in any way unsafe had not been taken out of service until restored to safe operating conditions: a) 23 Double Trouble Road, Bayville, NJ 08721: On or about October 9, 2014, employees operated a Yale forklift with a broken windshield. NOTE: THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT CERTIFICATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.
