29 CFR 1910.106(e)(2)(iii): Areas in which flammable liquids are transferred from one tank or container to another container shall be separated from other operations in the building by adequate distance or by construction having adequate fire resistance. Drainage or other means shall be provided to control spills. Adequate natural or mechanical ventilation shall be provided.   a)    Wagner Equipment Co. at 18000 Smith Road, Aurora, CO 80011: On and before 10/7/14, the employer did not ensure that flammable liquids in the machine shop area were transferred from one container to another container was separated from other operations in the building. The transfer was being conducted next to the mechanical work of an RV, no drainage or secondary containment was provided to control spills. This condition exposed employees to a fire hazard.           Abatement Note:  Abatement certification is required for this item (see enclosed "Certification of Corrective Action Worksheet").

29 CFR 1910.106(e)(6)(i): Adequate precautions shall be taken to prevent the ignition of flammable vapors. Sources of ignition include but are not limited to open flames; lightning; smoking; cutting and welding; hot surfaces; frictional heat; static, electrical, and mechanical sparks; spontaneous ignition, including heat-producing chemical reactions; and radiant heat.       a)    Wagner Equipment Co. at 18000 Smith Road, Aurora, CO 80011: On and before 10/7/14, the employer did not ensure that adequate precaution was taken to prevent the ignition of flammable vapors in the wash bay area. This condition exposed employees to a fire hazard which resulted in two employees being injured with 2nd and 3rd degree burns. 29 CFR 1910.106(e)(6)(ii): Category 1 or 2 flammable liquids, or Category 3 flammable liquids with a flashpoint below 100 °F (37.8 °C), shall not be dispensed into containers unless the nozzle and container are electrically interconnected. Where the metallic floorplate on which the container stands while filling is electrically connected to the fill stem or where the fill stem is bonded to the container during filling operations by means of a bond wire, the provisions of this section shall be deemed to have been complied with.       a)    Wagner Equipment Co. at 18000 Smith Road, Aurora, CO 80011: On and before 10/7/14, the employer did not ensure that flammable liquids in the machine shop area were dispensed into containers unless the nozzle and container are electrically grounded. The 4 black 55 gallon drums were not electrically bonded and grounded while transferring flammable liquids. This condition exposed employees to a fire hazard. 29 CFR 1910.106(e)(9)(ii): Adequate aisles shall be maintained for unobstructed movement of personnel and so that fire protection equipment can be brought to bear on any part of flammable liquid storage, use, or any unit physical operation.  a)    Wagner Equipment Co. at 18000 Smith Road, Aurora, CO 80011: On and before 10/7/14, the employer did not ensure that flammable liquids stored in the machine shop area had adequate aisles free from obstruction of personnel and so that fire protection can be brought in. The flammable storage area was blocked by 2 RVs in the shop.  This condition exposed employees to a fire hazard. 29 CFR 1910.1200(h)(1): Employers shall provide employees with effective information and training on hazardous chemicals in their work area at the time of their initial assignment, and whenever a new chemical hazard the employees have not previously been trained about is introduced into their work area. Information and training may be designed to cover categories of hazards (e.g., flammability, carcinogenicity) or specific chemicals. Chemical-specific information must always be available through labels and safety data sheets.    a)              Wagner Equipment Co. at 18000 Smith Road, Aurora, CO 80011: On and before 10/7/14, the employer did not ensure that employees were effectively informed and trained on new chemical hazards that was introduced into their work area. The employer had recently purchased a 55 gallon drum of Focus Dash, a brake parts wash for the shop and did not train their employees. This condition exposed employees to a chemical and fire hazard.        Abatement Note:  Abatement certification is required for this item (see enclosed "Certification of Corrective Action Worksheet").
