OSH ACT of 1970 Section (5)(a)(1): Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that caused or were likely to cause death or serious physical harm in that employees were exposed to combustible dust explosion, deflagration, or other fire hazards while working at or near dust collection system which were not adequately designed to prevent or minimize employee exposure in the event of a deflagration or other uncontrolled fire event:  (a) Kerr Millwork Corporation on or about October 15, 2014 at approximately 1200 had a dust ventilation capture system that was not protected from a deflagration hazard by a fire suppression system or other means of protection.  Kerr Millwork had not followed go engineering guidelines and either placed the collection system out of doors or followed NFPA guidelines for deflagration and spark control.  Dust collected at the site exhibited explosive characteristics with a Kst of 20.80 and a Pressure Ratio of 7.58.   NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM.  FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.
