29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels was not protected by guardrail systems, safety net systems, personal fall arrest systems, or an alternative fall protection measure under another provision of paragraph 1926.501 (b), nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502: (a) Roof, new residential construction located at 1230 Wellington Place, Alpharetta, GA 30009: Employee was exposed to falls while engaged in residential roofing activities on a 8/12 pitched roof at eave heights of approximately 21-feet, 6-inches from the lower level with no fall protection system in place.

29 CFR 1926.502(d)(17): The attachment point of the body belt was not located in the center of the wearer's back. The attachment point of the body narness was not located in the center of the wearer's back near shoulder level, or above the wearer's head. (a) Roof, new residential construction located at 1230 Wellington Place, Alpharetta, GA 30009: Employee using a positioning belt as a fall protection system on an 11/12 pitched roof at eave heights of approximately 16-feet was not protected from fall hazards as an inadequate fall protection system was used. The attachment to the life-line was not made at the wearer's back on the D-Ring. A positioning device can not be used as a personal fall arrest system.
