OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck by and crush hazards from crane/hoist operations, in that control pendants had not been marked as to the intended use of each button: a) On or about November 13, 2014 the employer failed to ensure that pendant control box of the Harrington under-hung crane located at Line #3 BBU 1131 within the powder room was clearly labeled for the purpose of directional functions. Employees were exposed to struck by hazards in the event of pressing the wrong directional button. b) On or about November 13, 2014 the employer failed to ensure that pendant control box of the Harrington under-hung crane located at Line #3 BBU 1132 within the powder room was clearly labeled for the purpose of directional functions. Employees were exposed to struck by hazards in the event of pressing the wrong directional button. c) On or about November 13, 2014 the employer failed to ensure that pendant control box of the Harrington under-hung crane located at Line #3 BBU 1133 within the powder room was clearly labeled for the purpose of directional functions. Employees were exposed to struck by hazards in the event of pressing the wrong directional button. d) On or about November 13, 2014 the employer failed to ensure that pendant control box of the Harrington under-hung crane located at Line #2 BBU 1121 within the powder room was clearly labeled for the purpose of directional functions. Employees were exposed to struck by hazards in the event of pressing the wrong directional button. e) On or about November 13, 2014 the employer failed to ensure that pendant control box of the Harrington under-hung crane located at Line #2 BBU 1122 within the powder room was clearly labeled for the purpose of directional functions. Employees were exposed to struck by hazards in the event of pressing the wrong directional button. Among other methods, feasible and acceptable methods to correct the hazardous condition may include: Following the requirements The American Society of Mechanical Engineers safety standard for cableways, cranes, derricks, hoists, hooks, jacks, and slings, ASME B30.16, chapter 16, section 16-1.1.2, and ensuring that pendant controls are clearly marked as to the purpose of the directional buttons.

29 CFR 1910.132(a): Protective equipment was not used when necessary whenever hazards capable of causing injury and impairment were encountered: a) On or about November 13, 2014 the employer failed to provide employees with appropriate personal protection equipment. Employees were exposed to hazards associated with falls of approximately six feet in that employees stand on the mid rail of a rolling stair case to check the inside of Vac-U-Max hoppers for powder accumulation.
