29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652(b) or (c). The employer had not complied with the provisions of 29 CFR 1926.652(b)(1)(i) in that the excavation be sloped at an angle not steeper than one and one half horizontal to one vertical, unless the employer uses on of the other options listed in 29 CFR 1926.652:     a)  South Center - Within Site - Future Sanitary Sewer Line, West Farm Road, Howell NJ:    Employees working in the bottom of a trench cut in soil Type C with dimensions of approximately 7 feet wide, in excess of 25 feet long, approximately 10 feet deep on the West side and approximate 14 feet 5 inches deep on the South side when outside of the trench box, on or about 10/09/14.    b)  North Center - Within Site - Well point Installation Line, West Farm Road, Howell NJ.  Employees working in an excavation directly next to an unshored, unsupported side wall (cut in soil Type C), with a height of approximately 8 feet, on or about 10/09/14.    NOTE:  IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR ITEM/INSTANCE a, FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.

29 CFR 1926.651(c)(2): A stairway, ladder, ramp or other safe means of egress was not located in trench excavations that were 4 feet (1.22m) or more in depth so as to require no more than 25 feet (7.62m) of lateral travel for employees:    a)  South Center - Within Site - Future Sanitary Sewer Line, West Farm Road, Howell NJ:    Employees working in the bottom of a trench with dimensions of approximately 7 feet wide, in excess of 25 feet long, approximately 10 feet deep on the West side, and approximate 14 feet 5 inches deep on the South side did not have a proper means of access/egress.  The trench was cut in soil type C.  Condition existed on or about 10/09/14.     NOTE:  IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM, FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.    Mazzara Trucking and Excavation Corp. was previously cited for a Repeat violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.651(c)(2), which was contained in OSHA inspection number 951733, citation number 2, item number 1 and was affirmed as a final order on 04/09/14, with respect to a workplace located at Green St and West Ave, Woodstown, NJ.    Mazzara Trucking and Excavation Corp. was previously cited for a Serious violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.651(c)(2), which was contained in OSHA inspection number 329942, citation number 1, item number 1 and was affirmed as a final order on 07/31/12, with respect to a workplace located at Pelham Rd at Willow Ridge, Marlton, NJ.

29 CFR 1926.651(k)(1): An inspection of the excavations, the adjacent areas, and protective systems was not conducted by the competent person prior to the start of work and as needed throughout the shift:    a)  South Center - Within Site - Future Sanitary Sewer Line, West Farm Road, Howell NJ:    The worksite trench with dimensions of approximately 7 feet wide, in excess of 25 feet long, approximately 10 feet deep on the West side and approximate 14 feet 5 inches deep on the South side when outside of the trench box had not been inspected by a "competent person" prior to and throughout the day.  The soil type that the trench was cut in was soil type C.  Observed on or about 10/09/14.    b)  North Center - Within Site - Well point Installation Line, West Farm Road, Howell NJ.  The worksite excavation with an unshored, unsupported side wall, with a height of approximately 8 feet, had not been inspected by a "competent person" prior to and throughout the day.
