29 CFR 1926.100(a): Employees working in areas where there was a possible danger of head injury from impact, or falling or flying objects, or from electrical shock and burns, were not protected by protective helmets:  On October 16, 2014 an employee was not protected by a hard hat while working in an trench, exposing the employee to a struck-by hazard from the spoil pile and rocks.  Abatement certification is required of this item in accordance with the requirements of 29 CFR 1903.19(c).

29 CFR 1926.651(j)(2): Protection was not provided by placing and keeping excavated or other materials or equipment at least 2 feet (.61m) from the edge of excavations, or by the use of retaining devices that were sufficient to prevent materials or equipment from falling or rolling into excavations, or by a combination of both if necessary.   On October 16, 2014 employees were exposed to a struck-by hazard while working in a trench where excavated material was not placed at least two feet from the trench edge.    Abatement certification is required of this item in accordance with the requirements of 29 CFR 1903.19(c).

29 CFR 1926.651(k)(1): An inspection of the excavations, the adjacent areas, and protective systems was not conducted by the competent person prior to the start of work and as needed throughout the shift:  On October 15 and 16, 2014 employees were exposed to the hazards associated with working in and around excavation where a competent person had not conducted inspections of the excavation and surrounding area.  Abatement documentation is required of this item in accordance with the requirements of 29 CFR 1903.19(d).

29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652(c).    On October 15 and 16, 2014 employees were not protected from a cave-in while working in an unprotected trench at a depth of 6.5 feet, exposing the employee to the hazards associated with a cave-in.   Abatement documentation is required of this item in accordance with the requirements of 29 CFR 1903.19(d).
