29 CFR 1926.453(b)(2)(v): A body belt shall be worn and a lanyard attached to the boom or basket when working from an aerial lift. Note to paragraph (b)(2)(v): As of January 1, 1998, subpart M of this part (1926.502(d)) provides that body belts are not acceptable as part of a personal fall arrest system. The use of a body belt in a tethering system or in a restraint system is acceptable and is regulated under 1926.502(e). (a) Far left-side of the building entrance - On or about October 7, 2014 an employee was exposed to a fall hazard while working in a Genie S-40 aerial lift serial no. JR4344. This employee was elevated 19.8 feet above the ground with no fall protection.

29 CFR 1926.454(a): The employer shall have each employee who performs work while on a scaffold trained by a person qualified in the subject matter to recognize the hazards associated with the type of scaffold being used and to understand the procedures to control or minimize those hazards. The training shall include the following areas, as applicable: (a) Far left-side of the building entrance - On or about October 7, 2014 an employee was exposed to a fall hazard while working in a Genie S-40 aerial lift serial no. JR4344. One employee stated he had never received any training about the hazards of associated with working on an aerial lift such as: electrocution, tip-over, high winds, falls, collisions, explosions, fires, and damaged machinery.

This employee was sitting on the rails of the aerial lift.
