29 CFR 1910.178(p)(1): If at any time a powered industrial truck is found to be in need of repair, defective, or in any way unsafe, the truck shall be taken out of service until it has been restored to safe operating condition. a. At the workplace, a John Deere Gator 4x2 was not taken out of service when it was in need of repair. The foot actuated brake had broken leaving only the hand operated parking brake as an on-demand means for stopping and/or slowing.

29 CFR 1910.305(g)(2)(ii): Flexible cords may be used only in continuous lengths without splice or tap. Hard-service cord and junior hard-service cord No. 14 and larger may be repaired if spliced so that the splice retains the insulation, outer sheath properties, and usage characteristics of the cord being spliced. a. At the workplace, in the Filling area, an electrical cable had a wire nut splice exposing employees to potential fire hazards. The electrical cable provided power to a gasoline storage tank's transfer pump.
