29 CFR 1910.119(d)(3)(ii):  The employer did not document that the equipment in the process complied with recognized and generally accepted good engineering practices.       The employer does not ensure that it documents that equipment in the process complies with recognized and generally accepted good engineering practices (RAGAGEP).       a.     The violation occurred in the Aeropres Cotton Valley Terminal on or about October 20, 2014 and at times prior thereto. Employees were exposed to fire and explosion hazards when the employer failed to ensure relief valve vent pipes had drains or caps installed and that those drains that were installed were directed away from the vessel in accordance with recognized and generally accepted good engineering practice (RAGAGEP) such as NFPA-58.       Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the abatement date the employer must submit documentation showing it is in compliance with the standard, including describing the steps it is taking to ensure that it documents that equipment in the process complied with recognized and generally accepted good engineering practices (RAGAGEP).

29 CFR 1910.119(f)(4):  The employer did not develop and implement safe work practices for employees and contractor employees to provide for the control of hazards during operations such as lockout/tagout; confined space entry; opening process equipment or piping; and control over entrance into a facility by maintenance, contractor, laboratory, or other support personnel.      The employer does not ensure safe work practices are established and implemented for control of entrance into the facility by maintenance, contractor, or other support personnel.      The violation occurred in the Aeropres Cotton Valley Terminal on or about October 20, 2014 and at times prior thereto. Employees were exposed to fire and explosion hazards when the employer failed to ensure work practices were developed and implemented for control of entrance into the facility by contract personnel including maintenance contractors and trucks drivers that loaded products from the facility.      Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the abatement date the employer must submit documentation showing it is in compliance with the standard, including describing the steps it is taking to ensure safe work practices were are established and implemented for control of entrance into the facility by maintenance, contractor, or other support personnel.

The employer does not ensure written procedures are established and implemented to maintain the on-going mechanical integrity of the process equipment.      The violation occurred in the Aeropres Cotton Valley Terminal on or about October 20, 2014 and at times prior thereto. Employees were exposed to fire and explosion hazards when the employer failed to ensure written procedures were established and implemented for the inspection of process equipment relief valve vent pipe vent caps and drains. Process equipment relief valve vent pipes include but are not limited to:       a.     Propane Vessels (1-4)   b.     ISO Butane Vessel (7)   c.     Normal Butane Vessel (8)   d.     Recovery Vessel.      Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the abatement date the employer must submit documentation showing it is in compliance with the standard, including describing the steps it is taking to ensure written procedures are established and implemented to maintain the on-going mechanical integrity of the process equipment.

29 CFR 1910.305(g)(1)(iv)(A): Unless specifically permitted otherwise in paragraph (g)(1)(ii) of this section, flexible cords and cables may not be used as a substitute for the fixed wiring of a structure.      The employer does not ensure electrical cords or cables are not used for fixed wiring in the structure.      a. The violation occurred in the Aeropres Cotton Valley Terminal on or about October 20, 2014 and at times prior thereto. Employees were exposed to electrocution hazards when the employer failed to ensure that the wiring for the scale sump pump outside of the truck scale building was fixed wiring rather than flexible cord.      Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the abatement date the employer must submit documentation showing it is in compliance with the standard, including describing the steps it is taking to not ensure electrical cords or cables were not used for fixed wiring in the structure.

The employer does not ensure that defects or evidence of damage to a flexible cord set that might expose employees to injury were removed from service until repairs or tests were made to render the equipment safe.    a. The violation occurred in the Aeropres Cotton Valley Terminal on or about October 20, 2014 and at times prior thereto. Employees were exposed to electrocution hazards when the employer failed to ensure that the flexible cord installed outside of the truck scale building and used to power the scale sump pump was removed from service until it was repaired or rendered safe.    Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the abatement date the employer must submit documentation showing it is in compliance with the standard, including describing the steps it is taking to ensure that defects or evidence of damage to a flexible cord set that might expose employees to injury were removed from service until repairs or tests were made to render the equipment safe.
