29 CFR 1926.20(b)(2): Frequent and regular inspections of the job sites, materials, and equipment were not made by a competent person(s) designated by the employer: a) On or about 10/20/14, on the flat roof of the Burlington Coat Factory Roof at 2001 Walden Ave., Cheektowaga, NY: Two employees were exposed to a potential fall of approx.. 23 ft. to the ground while cutting and pointing a masonry wall perpendicular to the roof edge in the area next to the Baby Depot store. Frequent and regular inspections of this jobsite, materials, and equipment were not conducted to ensure that a proper fall protection system was being utilized. NO ABATEMENT CERTIFICATION REQUIRED

29 CFR 1926.21(b)(2): The employer did not instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his/her environment to control or eliminate any hazards or other exposure to illness or injury: a) On or about 10/20/14, on the flat roof of the Burlington Coat Factory Roof at 2001 Walden Ave., Cheektowaga, NY: Two employees engaged in cutting and pointing a masonry wall running perpendicular to the roof edge in the area next to the Baby Depot store were not trained to recognize potential hazards on this type of jobsite, including but not limited to falls from the roof. They also were not trained in the applicable OSHA regulations to control or eliminate these hazards, and what fall protection systems could potentially be utilized on this jobsite to protect them from falling. ABATEMENT CERTIFICATION REQUIRED
