On or about October 20, 2014, the employer did not ensure personal protective equipment, such as hard hats were being worn by employees while working underneath other employees.  Employees were exposed to struck by hazards.

29 CFR 1926.501(b)(2)(i): Each employee who was constructing a leading edge 6 feet or more above lower levels was not protected from falling by guardrail systems, safety net systems, or personal fall arrest systems:  Note:  If the employer could demonstrate that it was infeasible or created a greater hazard to use these systems, a fall protection plan meeting the requirements of paragraph (k) of 1926.502 should have been developed and implemented.      On or about October 20, 2014, employees installing gutters onto a restaurant were working from the roof and roof edges without fall protection exposing the employees to falls of more than 15 feet to the concrete below.

29 CFR 1926.1053(b)(1): Portable ladders were used for access to an upper landing surface and the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface to which the ladder was used to gain access.    On or about October 20, 2014, employees performing installation activities accessed the roof area with extension ladders that the side rails did not extend at least 3 feet above the upper landing surface exposing them to a fall hazard of approximately 15 feet to the concrete below.      a)  Werner extension ladder, on the south side of restaurant, facing north, positioned below the guttering.  b)  Werner extension ladder, on the north side of restaurant, facing south, next to side walk, positioned below the guttering.
