OSH ACT of 1970 Section (5)(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to crushing hazards in that seatbelt use while operating forklifts is not enforced:  (a)  In the warehouse:  On October 22, 2014 and at times prior to; the employer failed to enforce the use of seat belts while operating forklifts such as, but not limited to the YALE and CAT forklifts, exposing the employee to a potential crushing hazard in the event of a tip or rollover.
