29 CFR 1926.1053(a)(1)(i): Self supporting portable ladders were not capable of supporting, without failure, at least four times the maximum intended load. Ladders built and tested in conformance with the applicable provisions of Appendix A of this subpart will be deemed to meet this requirement: On or about October 21, 2014, portable aluminum stepladders repaired by the employer had not been tested or approved for use by the manufacturer. Repaired ladders included: a) Ladder 1- Welded foot, both sides; support brackets have welded plates b) Ladder 2- Rivets replaced by screws on frame; left and right frames welded c) Ladder 4- Support brackets loose, welded on both sides, screws replacing rivets on right side of frame d) Ladder 5- Welds at all support brackets, screws replacing rivets at feet e) Ladder 7- Extensive welds on both sides of frame; brackets welded on both sides; welds on both feet f) Ladder 8- Extensive welds on both sides of frame; brackets welded on both sides; welds on both feet

29 CFR 1926.1053(b)(18): Ladder repairs did not restore the ladder to a condition meeting its original design criteria, before the ladder was returned to use: On or about October 21, 2014, portable aluminum ladders were put in use without having been restored to their original designs.
