29 CFR 1910.95(d)(1): A representative monitoring program was not developed and implemented when information indicated that an employee's exposure may equal or exceed an 8 hour time weighted average of 85dBA:      On or about 10/16/2014, the company did not have an established program for monitoring potential hearing loss and the employer failed to mandate the use of hearing protection for employees tasked with using a demolition hammer and/or concrete saw during landscaping activities. An employee tasked with breaking up a concrete block at a site located on South Taylor Rd. in Cleveland Heights, OH, was observed using a jack hammer and concrete saw without hearing protection and was potentially exposed to permanent hearing loss.
